These Terms and Conditions ("Terms") govern your access to and use of Lexorate, including our website and mobile applications (the "Service"), operated by ozpr s.r.o. ("Lexorate", "we", "us"). Please read them carefully. By accessing or using the Service, you agree to be bound by these Terms.
About the Service
Lexorate is a language-learning service that assesses spoken pronunciation. You record your speech, and we process it to provide automated feedback, assessment results, and progress tracking. Teachers and schools may use the Service to create classrooms, set assignments, and review their students' results.
Acceptance of Terms
By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Service.
Eligibility and Parental Consent
You must be old enough to consent to online services in your country — in the European Union this is typically 15 or 16, depending on where you live. If you are younger, you may use the Service only with the verifiable consent of a parent or guardian, or where your school provides an appropriate legal basis. A parent or guardian who consents to a child's use of the Service accepts these Terms on the child's behalf and is responsible for supervising that use.
Accounts
Some features require an account. Accounts may be created by you, by a parent or guardian, or by a school or teacher on a student's behalf, and you can sign in with an email and password or through Apple, Google, or Microsoft. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please notify us promptly of any unauthorised use.
Subscriptions and Payments
Some features are offered through paid subscriptions. Subscriptions are sold as auto-renewing in-app purchases through the Apple App Store or Google Play, which process the payment and billing — we never receive or store your full payment-card details. A subscription renews automatically for the same period unless you cancel it at least 24 hours before the current period ends; you can manage or cancel it in your App Store or Google Play account settings. Where your school provides access, your subscription may instead be sponsored by the school. Any free trial automatically converts to a paid subscription unless cancelled before the trial ends. Statutory withdrawal and refund rights apply in accordance with the relevant app-store terms and mandatory consumer law. We may also issue promotional coupon codes that grant a free subscription (for a month, a year, or for life). Coupon-based subscriptions are provided free of charge and may be cancelled, suspended, or discontinued by us at any time without compensation.
School and Classroom Use
Where a school or teacher invites you to a classroom or assigns you exercises, your assignment results, assessment scores, and progress data will be visible to the teachers and administrators responsible for that classroom. Schools and teachers are responsible for obtaining any consents required to enrol their students and for their own use of student data.
Acceptable Use
You agree to use the Service only for lawful purposes. You must not misuse the Service, attempt to disrupt or gain unauthorised access to it, upload unlawful or offensive content, infringe the rights of others, or record another person without their knowledge and consent.
Your Content and Voice Recordings
The Service requires you to submit voice recordings of your speech. You retain ownership of your recordings. By submitting them, you grant us a limited licence to store and process them, and to share them with the service providers that perform speech-to-text transcription and pronunciation and content assessment on our behalf, solely to operate and improve the Service. We handle this content as described in our Privacy Policy.
Notifications
With your permission, we may send push notifications to your device, such as reminders to practise or updates about your assignments. You can turn notifications off at any time in the app or in your device settings.
Leaderboards
The Service may show leaderboards. By default you appear anonymously. If you choose to show your name, your first name and last initial may be visible to other users on public leaderboards. You can switch back to anonymous at any time in your profile.
Privacy and Data Protection
We are committed to protecting your privacy. Our collection and use of your personal data is governed by our Privacy Policy, which complies with the General Data Protection Regulation (GDPR) and applicable Czech law. You can read our Privacy Policy here.
Intellectual Property
All content and materials forming part of the Service, including software, databases, text, graphics, and logos, are the property of Lexorate or its licensors and are protected by law. Except for your own content, you may not copy, modify, distribute, or create derivative works from the Service without our prior written permission.
Service Availability
The Service is provided on an "as is" and "as available" basis. While we work to keep the Service reliable, we do not guarantee that it will be uninterrupted, error-free, or that assessment results will be free from inaccuracies. We may modify, suspend, or discontinue any part of the Service at any time.
Limitation of Liability
To the fullest extent permitted by law, Lexorate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, use, or goodwill, arising out of or in connection with your use of the Service. Nothing in these Terms limits any liability that cannot be limited under applicable law.
Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if your use is harmful to other users, to us, or to third parties. On termination, the provisions that by their nature should survive will continue to apply.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the Czech Republic, and you submit to the exclusive jurisdiction of the courts of the Czech Republic, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
